This Privacy Policy is part of EverBee’s Terms of Use and describes the privacy practices of EverBee. It explains when and how EverBee collects end user and client information, including Personally Identifiable Information (defined below), how we use such information, and the circumstances under which we may disclose such information to others. This Privacy Policy includes the policies that EverBee observes for compliance with laws in the United States, as well as other applicable laws.

By visiting the EverBee website, visiting a EverBee client website that provides notice of its use of EverBee and/or this policy, or registering for our service, you acknowledge that you accept and consent to the practices outlined in this Privacy Policy.

 

  1. Information collected from EverBee’s visitors

    We may receive and collect certain Information furnished by the visitor’s browser, such as: 

  • Name

  • Email address

  • Website name and URL

  • Credit card number

  • Billing address

 

Information regarding your use of our site, and which websites you came to our Site from.

 

  1. What do we use your information for?

    We collect and use personal information and personal data from visitors to our site to:

  • Personalize your experience: Your information helps us to better respond to your individual needs.

  • To send periodic emails: The email address you provide for order processing, may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.

    The Site contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

  2. Third Party Disclosure

    We do not and will never share, disclose, sell, rent, or otherwise provide personal information to other third parties or companies for the marketing of their own products or services. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

    Still, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information we receive, or to otherwise protect our rights.

  3. Data Retention

    Our retention practices are: for the store owner, data is stored in our databases and is stored as long as the store owner continues using the software; when the store owner uninstalls the software, the data is deleted.
    We will only keep your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

  4. Your Rights

    You have the right to ask us to remove all data and/or personal information we hold about you. We will use reasonable endeavours to remove all information from our systems, including backups where technically feasible, within 30 days. You can exercise this right at any time by contacting us at hello@everbee.io. We may retain certain specific information, where required by law. There is no fee in relation to your request for erasure.

  5. Cookie policy

    We collect personal information directly from the relevant individual, through your EverBee account, or using the following technologies: “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org. “Log files” track actions occurring on the Site, and collect data including your IP address (***), web browser details, and time zone, date/time stamps on the particular device. Please note that if you set your browser to reject cookies, some features may be unavailable. Additionally, please note that rejecting cookies may also prevent you from opting out of our Service because that involves placing an opt-out cookie in your browser.

  6. Changes to our Privacy Policy

    EverBee may change this statement from time to time to reflect changes in our offerings, how we collect, use, or disclose personal information, or applicable law. If we make any changes to this Statement, we will change the “Last Updated” date above.

Refund Policy

Please read these Terms of Service, Policy. Together, these TWO (2) artifacts form a unified agreement (“Agreement”) that applies to all users of our Software. This Agreement is between EverBee (“EverBee”, “We”, “Our” or “Us”) and the natural or legal person agreeing to it (“Customer”, “You” or “Your”) and contains important information about Your use of Our Site and / or Software.

BY USING OR ACCESSING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS, POLICIES AND GUIDELINES INCORPORATED IN THE TERMS OF USE BY REFERENCE, INCLUDING, BUT NOT LIMITED TO EVERBEE PRIVACY POLICY (COLLECTIVELY, THIS “AGREEMENT”). BY USING OR ACCESSING THE SERVICES, YOU REPRESENT THAT YOU ARE AT LEAST 13 YEARS OF AGE. THIS AGREEMENT IS LEGALLY BINDING AND CONDITIONS YOUR USE OF THE SERVICES. If you do not agree to all the terms and conditions of this Agreement, you must discontinue use of the Services.

If you accept this Agreement, you represent that you have the capacity to be bound by it or if you are acting on behalf of a company or entity that you have the authority to bind such entity.

 

FEES

 

1.1 Subscription terms. Subscription Plans are billed in advance of their respective terms and automatically renew at the end of their respective terms for an equivalent term, or as otherwise stated in the Order Form, unless customer chooses not to renew such plan by writing to EverBee at hello@everbee.io Or EverBee terminates the Agreement.

 

1.2 Payment of fees. As an express condition of your use of and access to the Services, you agree to pay all fees applicable to your Plan, any other fees for additional services you may purchase, and any applicable taxes in connection with your use of the Services.

 

We will bill the fees due under your Plan to the credit card you provide to us during registration (or to a different credit card if you change your payment information). You acknowledge that the amount billed for each renewal period may vary due to promotional offers, changes in your Plan, and changes in applicable taxes, and you authorize us to bill you the corresponding amounts. We reserve the right to deactivate your access to the Services for failure to pay applicable fees as described in this Agreement. Unless otherwise stated, all fees are stated in U.S. Dollars.

 

1.3 Credit card payments. All fees for your Plan will be billed to your credit card. You authorize the card issuer to pay any amounts described herein and associated with your Plan and authorize us (or a billing agent acting on our behalf) to continue charging all such amounts to your credit card account until you, or we, cancel or terminate your Plan as provided herein or these amounts are paid in full, whichever is later.

 

You must provide current, complete and accurate billing and credit card information. Furthermore, you must promptly update all billing information (such as billing address, card number and expiration date) to keep your account current, complete and accurate, and you must promptly contact EverBee if your credit card is lost or stolen, or if you become aware of a potential breach of account security (such as an unauthorized disclosure or use of your EverBee username or password).

 

1.4 Refunds. If you contact us within three (3) days of purchasing any EverBee services to terminate such services, we will refund the amount of your LAST PAYMENT to EverBee. This provision shall apply to monthly, yearly and/or lifetime service plans.

 

1.5 Upgrade and downgrade terms. If you upgrade your Plan level, your credit card will immediately be charged a pro-rated amount reflecting the increased rate, and you will be charged the full amount of the new rate beginning with your next billing cycle. If you downgrade your Plan level, your credit card will automatically be charged the new rate beginning with your next billing cycle. Downgrading your Plan may cause the loss of account content, features, or capacity. EverBee does not accept any liability for such loss.


1.6 Free plan. EverBee may offer, during the registration process, a free plan during which you can try out the software from the date you register to use the EverBee without pre-paying in advance (“Hobby Plan”).
